1. General provisions
1.1. These terms of purchase (the Terms) set out the mutual rights, obligations and liability of the Buyer and the Seller of the VAKA Sport online shop (vakasport.lt).

1.3. Buyer: a legally capable natural person (aged 18 or over), a minor (aged 14 to 18) with parental consent, or a legal entity buying goods in the online shop.
1.4. By confirming an order, the Buyer confirms that they have read these Terms and agree to comply with them.
1.5. The Seller reserves the right to change the Terms. Changes take effect when published on the website. The Terms in force at the time the order is placed apply to the Buyer.
2. Purchase agreement
2.1. The purchase agreement is concluded when the Buyer fills the shopping cart, enters delivery details, selects a payment method and clicks "Confirm order".
2.2. Every concluded agreement is registered and stored in the shop's system.
2.3. The agreement remains valid until the parties have fully met their obligations.
3. Prices and payment
3.1. Prices are in euros and include VAT (21%). The delivery cost is shown when placing the order and is not included in the product price.
3.2. The Seller may change prices, but the price valid at the time the order was placed applies to the Buyer.
3.3. Payment methods:
- Paysera : bank payments, debit and credit cards.
- Bank transfer : against a prepayment invoice. The order is processed once payment is received.
- Payment on collection : payment when collecting the goods from the warehouse in Kaunas.
3.4. If the Buyer does not pay within 3 working days of order confirmation (when paying by bank transfer), the Seller may cancel the order without separate notice.
4. Buyer's rights and obligations
4.1. The Buyer has the right to:
- Buy goods in accordance with these Terms.
- Withdraw from the agreement within 14 days of delivery (Civil Code of the Republic of Lithuania, Art. 6.228-10).
- Request replacement of a faulty item or a refund.
- Receive full information about the product before buying.
4.2. The Buyer undertakes to:
- Provide correct delivery details.
- Accept the ordered goods and pay the agreed price.
- Check the condition of the parcel on delivery.
- Comply with these Terms and the laws of the Republic of Lithuania.
5. Seller's rights and obligations
5.1. The Seller undertakes to:
- Enable the Buyer to use the shop's services.
- Deliver goods under the conditions set out in these Terms.
- Provide accurate information about the goods sold.
- Respect and protect the Buyer's personal data in accordance with the Privacy Policy.
5.2. The Seller has the right to:
- Change the shop's range and prices.
- Cancel an order if the Buyer does not pay within 3 working days.
- Temporarily suspend the shop for technical reasons.
- If an ordered item is not in stock, the Seller will contact the Buyer and offer an alternative or refund the amount paid within 5 working days.
6. Delivery
6.1. Goods are delivered to the address given by the Buyer, to the chosen parcel locker or pickup point, or collected from the warehouse in Kaunas (by prior arrangement).
6.2. Delivery times and costs depend on the size of the item and the delivery zone. Exact prices are shown when placing the order.
6.3. Standard delivery in Lithuania: 1–4 working days. Delivery of kayaks and other bulky items may take up to 5 working days.
6.4. The Buyer must check the packaging and condition of the goods on delivery. If damage is noticed, the Buyer must record it with the courier and inform the Seller. Otherwise the Seller is released from liability for damage to the packaging.
6.5. Delivery may be delayed due to force majeure. In that case the Seller will inform the Buyer and agree new terms.
7. Returns and right of withdrawal
7.1. The Buyer has the right to withdraw from the agreement within 14 calendar days of delivery without giving a reason (Civil Code of the Republic of Lithuania, Art. 6.228-10).
7.2. Return procedure:

- Pack the item in its original packaging and include proof of purchase.
- Send the item to: MB Vandenynas, Girios g. 4-8, LT-47338 Kaunas, Lithuania.
- Refund : within 14 days of receiving and inspecting the returned item.
7.3. Return conditions:
- The item must be in its original packaging, unused, undamaged and complete.
- Proof of purchase is provided (invoice, order confirmation or email).
- Return shipping costs are paid by the Buyer, unless the item is faulty.
- Returned items are inspected within 5 working days.
7.4. Returns do not apply to:
- Items that have been used in water (launched, tested).
- Items with custom order modifications.
- Items whose packaging was damaged through the Buyer's fault.
Note: if a kayak or SUP board set has been tested in water, it cannot be returned, as the item is considered used.
8. Warranty
8.1. 2-year warranty on all products (for consumers, under the Civil Code of the Republic of Lithuania). For legal entities, the manufacturer's warranty periods apply.
8.2. The warranty covers manufacturing defects and material faults.
8.3. The warranty does not cover:
- Damage caused by improper use, storage or transport.
- Normal wear and tear (scratches, colour change from UV).
- Damage caused by unauthorised modifications or repairs.

8.5. If an item or part is replaced during the warranty period, the replaced part receives a new 2-year warranty period.
9. Liability
9.1. The Seller is not liable for losses resulting from improper use of the product or failure to follow the manufacturer's instructions.
9.2. Water sports equipment is used at the Buyer's own responsibility. The Buyer must:
- Follow the manufacturer's instructions for use and care.
- Use life jackets and other safety equipment.
- Assess weather, water and environmental conditions before using the equipment.
- Have sufficient preparation and experience for safe activity on the water.
9.3. The Seller accepts no liability for injuries, accidents or damage to third parties resulting from improper use of the product.
9.4. The Buyer is responsible for the accuracy of the data provided in the registration form and for keeping their login details safe.
10. Dispute resolution
10.1. Disputes are resolved by negotiation. If no agreement is reached, the Buyer may contact:

10.2. These Terms are governed by the law of the Republic of Lithuania.
11. Final provisions
11.1. These Terms are based on the Civil Code of the Republic of Lithuania, the Law on Consumer Protection and other legislation of the Republic of Lithuania.
11.2. If any provision of these Terms is found invalid, the remaining provisions remain in force.
